SECTION ONE
Purpose, Scope, Legal Ground and Definitions
Purpose
ARTICLE 1 – (1) The purpose of these rules and regulations is to govern the applicable principles and procedures for the management and operation of the Özyeğin University Research Center for German Law founded under the umbrella of the Özyeğin University Rector’s Office.
Scope
ARTICLE 2 – (1) These rules and regulations cover the provisions relating to the mission, activities, managing bodies, and the roles and responsibilities of the managing bodies of Özyeğin University Research Center for German Law.
Legal Ground
ARTICLE 3 – (1) These rules and regulations are prepared pursuant to Article 7, paragraph 1, sub-paragraph (d); and item (2); and Article 14 of Higher Education Law No: 2547.
Definitions
ARTICLE 4 – (1) The following terms shall have the following meanings hereinafter these rules and regulations:
a) Advisory Board: The Advisory Board of the Center
b) Center: Özyeğin University Research Center for German Law
c) Director: Director of the Center,
ç) Rector: Özyeğin University Rector,
d) University: Özyeğin University,
e) Administrative Board: Administrative Board of the Center
SECTION TWO
Mission and Activities
Mission of the Center
ARTICLE 5 – (1) The mission of the center is conduct research on German Law, which has a major influence on Turkish Law, exchange the results of research conducted, and share with legal circles the fundamental laws and judicial rulings of German Law as well as scholarly work conducted in the areas of German law that influenced Turkish law considering their potential impact on Turkish Law.
Activities of the Center
ARTICLE 6 – (1) The Center undertakes the following activities in quest to pursue its mission defined in Article 5 of these rules and regulations:
a) To organize and participate in national and international seminars, conferences, colloquia and similar events,
b) To produce and contribute to publications in Turkish or foreign languages about German law,
c) To build and develop relationships with national and international institutions in the relevant field,
ç) To build a multi-lingual library that provides national and international resources and publications in the relevant field as well as any other necessary facility and create an archive,
d) To form temporary or permanent commissions, when necessary, in quest to conduct research, reviews, projects and similar other scholarly activities and, to that end, to cooperate and collaborate with national and international experts in the relevant field,
e) To offer scientific and professional courses, seminars and similar events on a regular basis in quest to contribute to the professional development of the staff employed in the relevant institutions and organizations; or participate in such events organized by the relevant institutions and organizations,
f) To plan and organize trainings, certificate programs, courses, seminars and conferences on German law, comparative law and international law for the public and private sector as well as international institutions and persons; or participate in and engage in collaborations to contribute to such events organized by the relevant institutions.
g) To provide students with multidimensional skills through certificate programs on German law, comparative law and international law,
ğ) To enter into cooperation and collaboration with universities and institutions both in Turkey and around the world in accord with the center’s mission
h)To produce national and international publications and facilitate the exchange of knowledge,
ı) To conduct research on the new fields of German Law and transfer the current practices to Turkish Law,
i) To prepare, present, contribute to and conduct national and international projects in the relevant field,
j) To provide professional consultancy services in the relevant field to institutions and organizations as long as the work load allows,
k) To organize any other events and produce publications that relate to the activities of the center
SECTION THREE
Managing Bodies and Their Roles and Responsibilities
Managing Bodies
ARTICLE 7 – (1) The managing bodies of the Center are as follows:
a) Director,
b) Administrative Board,
c) Advisory Board.
Director
ARTICLE 8 – (1) The Director is selected and assigned by the Rector, among full time faculty members of the university upon the recommendation of the Administrative Board for a period of three years. At the end of the term of office, the Director can be re-appointed. In lieu of a deputy director who has served for more than six months, a new director is appointed. The Director reports to the Rector and is responsible for managing and improving the activities of the Center.
(2)Maximum two persons can be assigned as Vice Director by the Rector upon the recommendation of the Director for a period of two years. Vice Directors are responsible for tasks and responsibilities assigned by the Director. The Director assigns one of the Vice Directors as his/her Proxy in his/her absence.
The Roles and Responsibilities of the Director
ARTICLE 9 – (1) The Director is expected to fulfill the following roles and responsibilities:
a) To represent the Center,
b) To manage and improve the activities of the Center,
c) To execute the decisions of the Administrative Board,
ç) To call the Administrative Board for meetings, and set the agenda of and preside over the Administrative Board meetings,
d) To collaborate with the national and international institutions in the same field,
e) To call the Advisory Board for ordinary and extraordinary meetings, and set the agenda of and preside over the Advisory Board Meetings,
f) To evaluate and make the final decisions about consultancy requests received by the Center based on the current workload,
g) To prepare the annual activity report of the Center as well as the action plan for the subsequent year and submit the final versions that are approved by the Administrative Board to the Rector
Administrative Board
ARTICLE 10 – (1) The Administrative Board consists of the Director and five persons assigned among the expert faculty members of the University by the Rector for a period of two years. Members whose terms of office have ended can be re-assigned. The Director is the chair of the Administrative Board.
(2) The Administrative Board convenes at least once in every four months.
The Roles and Responsibilities of the Administrative Board
ARTICLE 11 – (1) The roles and responsibilities of the Administrative Board are as follows:
a) To make decisions about the activities and management of the Center,
b) To discuss and make final decisions about the annual activity report and the annual action plan,
c) To provide support in training and education in the field of the Center’s line of business
ç) To provide a platform to develop and improve the activities and services of the Center
Advisory Board
ARTICLE 12 – (1) The Advisory Board consists of at least twelve members who are faculty members; or representatives of prominent national and international institutions operating in the same field as the Center; or those believed to make valuable contributions to the Center with their work. The members of the Advisory Board are assigned for a period of two years by the Rector upon the recommendation of the Administrative Board. Members whose terms of office expire can be re-assigned.
(2) The Advisory Board can meet annually for its ordinary meeting. The Director, when necessary, may call the Advisory Board for an extraordinary meeting. The Advisory Board meets with the absolute majority of its members.
The Roles and Responsibilities of the Advisory Board
ARTICLE 13 – (1) The roles and responsibilities of the Advisory Board are as follows:
a) To provide the necessary evaluations and recommendations about the activities of the center,
b) To provide consultancy to the Administrative Board about the activities of the Center
c) To engage in collaborations with the relevant institutions and give suggestions about the activities of the center
SECTION FOUR
Miscellaneous and Final Provisions
Staffing Needs
ARTICLE 14 – (1) The Center meets its staffing needs for academic, technical and administrative personnel with the staff assigned by the Rector upon the recommendation of the Director as per Article 13 of Law No:2547.
Effectiveness
ARTICLE 15 – (1) These rules and regulations take effect as of the date of their publication.
Execution
ARTICLE 16 – (1) These rules and regulations are executed by the Özyeğin University Rector
